Global Structuring

A UAE Tax Residency Certificate (TRC) is issued by the Federal Tax Authority to confirm tax residence for a specified period. For individuals, the domestic rules include a 183-day test, a conditional 90-day test and a separate test based on where their home and personal and financial interests are centred. The correct certificate also depends on whether it is needed for a tax treaty or another purpose.

This guide focuses on individuals, including people considering the UAE Golden Visa. It explains how to assess the relevant route, organise evidence and prepare an application without confusing an immigration document with a tax conclusion.

Is a UAE residence visa the same as tax residency?

A residence visa is not a Tax Residency Certificate. Immigration permission allows an eligible holder to reside in the UAE. Tax residence requires a separate assessment of the applicable facts and rules.

As Dubai’s official tax residency explanation makes clear, domestic tax residence and being a resident person for Corporate Tax are also distinct concepts. An individual should not assume that obtaining a visa either settles their international tax position or automatically creates a Corporate Tax obligation.

What are the UAE’s 90-day and 183-day tax residency tests?

Article 4 of Cabinet Decision No. 85 of 2022 provides three alternative routes for individuals under domestic law.

Domestic routePhysical presenceOther conditions
183-day testAt least 183 days within the relevant 12 consecutive monthsPhysical presence meets this domestic test
90-day testAt least 90 days within the relevant 12 consecutive monthsUAE or GCC nationality, or a valid UAE residence permit, plus a permanent UAE home or UAE employment or business
Home and centre of interestsNo fixed minimum day count under this routeBoth the usual or primary residence and the centre of financial and personal interests must be in the UAE

Spending 90 days in the UAE is not sufficient on its own. Identify the additional condition being relied on and the documents that prove it. The home-and-interests route also requires a factual assessment rather than simply owning an apartment.

How are days counted, and must you own a home?

Under Ministerial Decision No. 27 of 2023, days need not be consecutive. A calendar day, or part of a day, of physical presence counts towards the relevant 12-month calculation. Record actual travel dates rather than estimating stays from flight bookings.

A permanent home can be rented. It must be continuously available with sufficient stability, rather than accommodation used only occasionally for short visits. The centre-of-interests assessment considers personal and economic connections, including family, work and business. The FTA may disregard presence caused by qualifying exceptional circumstances; do not assume every unplanned extension counts automatically.

Two examples of how the domestic tests work

Example 1: several visits exceed 183 days

An individual spends 88, 64 and 39 days in the UAE on three separate, non-overlapping visits during the same relevant 12-month period. The total is 191 days: 88 + 64 + 39. Assuming the days are properly evidenced and no exceptional-circumstance adjustment applies, this meets the domestic 183-day test. A single continuous stay is unnecessary.

Example 2: 110 days with a residence permit and home

A valid UAE residence-permit holder spends 110 days in the country during the relevant 12 months and rents a furnished home continuously available for their use. These facts can satisfy the conditional domestic 90-day route, subject to evidence and FTA review. They do not establish entitlement under every tax treaty or resolve residence in another country.

Domestic or treaty certificate: which should you request?

Domestic eligibility does not automatically establish treaty eligibility. Ask the recipient what the certificate will support before choosing the application type.

For a Double Taxation Agreement (DTA), Ministerial Decision No. 247 of 2023 requires the applicant to meet the residence conditions of the relevant agreement. Select the other country and examine that treaty’s wording, relevant period and evidence requirements. The 90-day domestic route should not be presented as a universal shortcut to treaty benefits.

If another country also regards you as resident, assess its domestic rules and any applicable treaty provisions. A UAE certificate is evidence for its stated purpose; it does not by itself cancel foreign tax obligations. Confirm whether the recipient needs its own form completed or authenticated as well.

What documents do individuals need for a UAE TRC?

The FTA’s application manual sets out identity and supporting information by application type. Prepare a file covering the requested period:

  • Passport, plus Emirates ID and residence-permit details where applicable.
  • An official entry-and-exit report from ICP or the competent local authority, reconciled to a travel schedule.
  • Employment, salary or business evidence where relevant to the chosen route.
  • A qualifying tenancy agreement or ownership documents and supporting accommodation evidence where relevant.
  • For the home-and-interests route, an explanation supported by records of your personal and financial connections.
  • Any additional documents or forms required for the selected treaty purpose.

Check that names, identification numbers and dates agree. Request evidence for the whole relevant period, not just the most recent month.

How much does a UAE Tax Residency Certificate cost?

The FTA’s published certificate fees distinguish registered and non-registered applicants. For an individual, the submission fee is AED 50, plus:

  • AED 500 for review and electronic issuance where the applicant qualifies as a registrant with a Corporate Tax TRN: AED 550 in total.
  • AED 1,000 for an individual without a Corporate Tax TRN: AED 1,050 in total.

Each requested hard copy adds AED 250. These figures exclude any professional assistance or other document-related costs. A VAT TRN alone does not provide the Corporate Tax registration fee reduction. Verify the applicable category before payment.

How do you apply, and what period does the certificate cover?

Apply through EmaraTax and the linked Tax Residency Certificate service. Choose the correct applicant, certificate purpose, country where relevant and requested period. Upload evidence, review the details, complete the required payments and submit. Keep the reference and respond to any clarification request.

The FTA’s Tax Resident and TRC guide gives a general response period of 10 business days after receipt of a complete application. That response may be approval, rejection or a request for information.

The certificate covers its stated period. It cannot cover more than 12 months or a period that has not started. An individual can apply for a current period once the residence criteria are met.
